Purchase agreement

The general terms and conditions set out below apply to all products/works of art/prints that are sold via this Phil Coucke website. 
By placing an order on this website the purchaser accepts the terms and conditions set out below without reservation. 
The purchase agreement is concluded as soon as the purchaser has received an e-mail confirming the purchase. From that moment the purchaser is obliged to receive the products that have been purchased at the time when they are made available.  If the purchaser refuses to receive them or does not provide the necessary information or instructions for receipt, the products intended for delivery will be stored at the purchaser’s risk and expense.

Price and payment

All prices on this website are stated in euros, including VAT and excluding delivery charges (unless otherwise stated for that item). 
Delivery charges depend on the value of the order and the country of delivery. No toll fees are charged. Any import/customs duties, however, are payable by the purchaser.
The prices that are displayed at the time when the order is placed are binding. 
Payment can be made using the methods of payment offered on the website, and is made over a secure connection. 
The purchaser also has the opportunity to transfer the amount to my account number (the number will be sent by e-mail on request). 
In that case the goods will be reserved for 7 days and the goods will be dispatched after the full purchase price has arrived in the account of Phil Coucke. If payment has not been received by us after this 7 day period, you will receive a reminder from us by e-mail. If no response to this e-mail is received within one day, the products will be offered for sale again. 
The products that are delivered remain the sole property of Phil Coucke until full payment has been made. Responsibility for the work of art passes to the purchaser on receipt of the work.

Postage & delivery

The product will be packaged with care and sent within one week to the address provided by the purchaser. If the purchaser has provided an incorrect address for delivery, the purchaser is liable to pay any additional delivery charges.
From experience, purchasers receive their orders at home after 10 to 14 days on average. If a longer delivery period is necessary due to special circumstances (e.g. extra frame, purchaser’s specific requirements etc.) we will inform the purchaser of this immediately.
We do our best to ensure that orders reach the purchaser as quickly as possible. If the purchaser desires a specific delivery time or priority delivery, this can of course be agreed by discussing it with Phil Coucke.
If there is visible damage at the time of delivery, the purchaser must refuse the delivery on an ‘as damaged’ basis, must inform the transport company of this and must return the work in its original packaging to Phil Coucke.  

Returns & exchanges

Right to return

The purchaser has the right to send back the items received within 10 days.
During this period, which begins at the time when the purchaser receives the items, the purchaser may return the goods in exchange for the purchase price, provided they are returned in their original packaging and the goods are received by Phil Coucke in a completely undamaged state. The purchaser remains liable for return delivery and for any damage.
After receiving the returned package we will refund the purchase price to the purchaser’s account. If you have paid by bank transfer, please provide your bank details when returning the items. This is requested because we do not store bank details. We will make reimbursements within 30 days. This period begins from the time when the returned package has been received and processed by us.

Exchanges
It is not possible to exchange any item for a different item.

Terms and conditions for returns
If you return items, you must enclose a letter with your return package clearly stating why you are returning the goods. All returns must be returned postage paid, and any returns with unpaid postage will not be accepted. The items must be sent unused and in the original packaging. The purchaser is liable to pay the delivery costs for returns. 

Returns relating to a complaint
We handle products and orders with great care. Nevertheless, things can still go wrong: an incorrect item can be sent by mistake, an order can be damaged during postage etc. 
Any complaints must be sent to us as quickly as possible and at the latest within five working days, by registered post. Please contact us before you return the item, because the complaint must be made clearly visible and identifiable. If you have a justified complaint you may return the item free of charge. If you have submitted any complaint too late, we are entitled to charge for all costs relating to repair or replacement, including administration and delivery charges. 
Phil Coucke also reserves the right to cancel an order placed in his web shop if the stated details or images were not correct for any reason whatsoever.

Important concluding notes

All photographs of the works of art have been made using a professional camera. Due to lighting, reflections etc. the photographs may, however, have minor differences in colour from the original work; these cannot constitute grounds for refusing the goods that have been sent out. 
The stated price only applies to the items as described in words. The accompanying photographs are intended for decorative purposes and may show elements that are not included in the price.
The works of art have been created with the greatest care. Some of the surfaces used, such as plexiglass, are experimental materials whose long-term characteristics are not known. Phil Coucke is not liable for this. We recommend handling the works of art with care and keeping them out of direct sunlight. It is also recommended to clean the glass in frames or painted plexiglass (only the unpainted side!) using special glass cleaning products. Sculptures are intended for indoor use only. 

In case of any disputes, the commercial court in our own legal district shall have jurisdiction.
